Introduction

Oral Chinese Test (“OCT”) recognizes the importance of protecting your privacy. This Privacy Policy (“Policy”) describes our practices related to personal information.

Personal Information is any information that we can use to identify you (such as your name, picture or date of birth) or contact you (such as your email, shipping address or phone number). Personal Information includes other types of information (such as test results and demographic data) when that information is associated with your Personal Information.

This Privacy Policy describes our practices with respect to Personal Information we collect via our “Service”. The term “Service” includes all OCT websites, mobile applications, platforms that collect personal information from you. It also describes our practices with respect to Personal Information collected in other ways, such as when you enroll and take OCT tests, OCT Learn or when we receive information from an Official Training Partner.

By using or accessing OCT Service or otherwise providing us with the Personal Information, you agree to our Privacy Policy. Capitalized terms not defined here have the meanings set forth in the Terms and Conditions, located at www.octtest.org/terms.

2. Children under Age of 13

Our service is not intended for children under 13 years of age. We do not knowingly collect Personal Information from children under 13. If you are under 13, you should not use our Service and enter any personal information about yourself on our Service. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that personal information. If you believe that a child under 13 has created an account on our Service, please contact us to have the account deactivated by sending us an email at contact@octtest.org.

3. Information OCT Collects

The amount and type of information that OCT gathers depends on the nature of the interaction. 

Account Registration and Profile Information

Through account registration process, you will provide us your first and last name, email address and password. When you use our Service, you may submit profile information (e.g., profile picture, gender, date of birth, shipping address) to your user profile.

OCT Test

If you enroll for OCT Test, you will provide us your transaction information and records, including payment date, history and method. You will also submit all required profile information. Each time you take a test you must provide a profile picture of you and take a photo of your face to verify your identity.

When you use the Service to take OCT Test, you must provide OCT access to your device’s camera and microphone. We will use them to take photographs of you to verify your identity and record your voice to submit answer to questions during test. You will also submit answers to other questions as part of the testing and evaluation process.

Communication Data

We collect and generate data about your use of our Service including your use of Content on Service. We may send you Service-related emails (e.g., email verification, changes/updates to features of the Service, technical and security notices). Note that you may not opt out of the Service-related emails.

We may also contact you to participate in product research activities, including surveys and other types of feedback sessions. When you participate in these research activities, the information you provide will be used to test, improve, and develop our products. We will retain this data permanently.

4. How OCT uses Your Personal Information

OCT will only process Personal Information where we have a lawful basis to do so. Personal Information collected through OCT Service may be used to:

  • Administer OCT Test, provide requested services to you, and communicate with you regarding services
  • Process requests for OCT Test and other services, and to communicate with you regarding such requests
  • Support test security and integrity, identify and authenticate test takers, and for related purposes (such prosecution of fraud or intellectual property theft)
  • Maintain your account, verify your identity and process payments
  • Use your information in an anonymous form, for informational, research and statistical purposes to administer, review and/or improve OCT services
  • Manage our internal business operations
  • Respond to your questions
  • Provide you with marketing information about OCT Test, services, or special offers from OCT
  • Invite you to participate in service research activities
  • Contact you through emails, text messages and/or phone calls regarding your requests of products and services

5. Data Retention

We will retain your Personal Information for as long as is necessary to fulfill any of uses identified in this Privacy Policy or to comply with applicable legal obligations. You may request that we delete your Personal Information by contacting us via email at contact@octtest.org. Unless we are required by law or have a legitimate interest to retain your information, we will delete it within 30 days of your request. If you ask us to delete your data, you won’t be able to access OCT account or test history report, or request any information from us.

6. Cookies

To enrich and perfect your online experience, OCT uses "Cookies", similar technologies and services provided by others to display personalized content, appropriate advertising and store your preferences on your computer. A cookie is a string of information that a website stores on a visitor's computer, and that the visitor's browser provides to the website each time the visitor returns. OCT uses cookies to identify and track visitors, their usage of Service and their Service access preferences.

If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to deny or accept the cookie feature; however, you should note that cookies may be necessary to provide you certain features available on the Website.  By continue using and accessing our website without changing your cookie settings, you hereby acknowledge and agree to OCT's use of cookies.

7. Social Media Interactions

Our Service may enable you to interact with us and others via social media platforms, such as Facebook®, LinkedIn®, Twitter® and Google®. While we respect each social media platform’s privacy policies, we may collect Personal Information about you and your friends/connections if you choose to use these tools.

8. Third Party Service

OCT Service may include links to third party websites, applications and services that are not owned or controlled by OCT. You may access Third Party Service directly or through our Service. Links from our Service to Third Party Service are provided solely for your convenience. You should review the privacy policy of Third Party Service before providing any information through these websites, applications and services. OCT is not responsible for the content or practices of any linked Third Party Service.

We use third-party services for payment processing. OCT does not have control such other services. Your payment details provided to our third-party payment processors whose use of your personal information is governed by their Privacy Policy.

9. Protection of Certain Personal Information

OCT discloses potentially Personal Information and Personal Information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on OCT's behalf or to provide services available at OCT's Service, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using OCT's Service, you consent to the transfer of such information to them. OCT will not rent or sell potentially Personal Information and Personal Information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, OCT discloses potentially Personal Information and Personal Information only in response to a subpoena, court order or other governmental request, or when OCT believes in good faith that disclosure is reasonably necessary to protect the property or rights of OCT, third parties or the public at large.

10. Your Rights and Choices

You have the right to know whether or not OCT maintains your Personal Information. If we do have your Personal Information, we will provide you with access to the personal information that we hold about you upon request (subject to the rights of others). If your information is incorrect or incomplete, you have the right to ask us to update it. You also have the right to object to our processing of your Personal Information and you may ask us to delete or restrict your Personal Information.

To exercise these rights, please contact us via email at contact@octtest.org, and a member of our Privacy Team will assist you. Please understand that we may need to verify your identify before we can process your request. Additionally, our ability to delete Personal Information will be limited in those cases where we are required to retain records, such as in connection with score reports and test security processes.

11. Security

OCT has implemented administrative and technical safeguards it believes are appropriate to protect the confidentiality, integrity and availability of your Personal Information. We use secure sockets layer (SSL) transmission, a protocol for establishing a secure connection for transmitting your Personal Information. OCT has security protocols and measures in place to protect your Personally Information from unauthorized access, alteration, and unlawful disclosure. When OCT disposes of Personally Information, we take reasonable measures to protect against unauthorized access to the information. But remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

12. Advertisements

Ads appearing on our Service may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by OCT and does not cover the use of cookies by any advertisers.

13. Aggregated Statistics

OCT may collect statistics about the behavior of visitors to its website. OCT may display this information publicly or provide it to others. However, OCT does not disclose your Personally Information.

14. International Users

OCT and its Service are located and operated in Hong Kong, requiring your information to be transferred from your location to Hong Kong, which may not provide the same level of protection for your personally identifiable information as your home country. The information may be available to the Hong Kong government or its agencies under a lawful order in Hong Kong. When you give information to OCT through our Service for any reason, including for any of the services we offer, you acknowledge a cross-border transfer of that information to Hong Kong. If you do not agree to this international transfer of data, do not use OCT Service. If you choose to revoke your consent to such transfer, and this is the lawful basis for the processing, we may cease processing your information.
